The Court stated the following regarding the evidence of the meaning of the term “The Rat Pack”:
Stated succinctly, Cunningham’s evidence establishes that, long before TRP offered live musical shows, the term the “The Rat Pack” had a meaning that was used in connection with the joint performances of members of the Rat Pack during the 1960s. While some of these performances included movie appearances, typically the joint performances were live musical performances. Since the 1960s, the term “The Rat Pack” has been used by producers of many types of goods or services to indicate that the goods or services relates to members of the Rat Pack or to the joint movie or live (or recorded) musical or movie performances of the Rat Pack during the 1960s. From its initial use to refer to members of the group, particularly when jointly performing live musical entertainment, “The Rat Pack” did not and, indeed, could not refer to or identify TRP’s live musical show.
The court acutely recognized that Defendants’ Motion was not directed towards TRP’s registered trademark but rather merely to the component term “The Rat Pack”:
The question before the court on Cunningham’s partial motion for summary judgment is not whether “The Rat Pack is Back” identifies and distinguishes TRP’s show in tribute to members of the Rat Pack from all other such live shows. Rather, the only question is whether the component term “The Rat Pack” so distinguishes TRP’s live show from all others about or in tribute to the Rat Pack. The evidence establishes that it does not and that TRP cannot appropriate the term “The Rat Pack” for its exclusive use.
And just to make it abundantly clear to TRP about the scope of its trademark rights, the court held that “As the term ‘The Rat Pack’ is generic in the context of live shows about or in tribute to members of the Rat Pack, TRP does not have an exclusive right to use the term ‘The Rat Pack.’”

Las Vegas Elvis Tribute Artist Johnny Thompson, The Official Elvis of MTV, 2007 International Images of the King World Champion, Host of the 2005 MTV Movie Awards Red Carpet and International Concert artist is
launching his new show " The King in Concert"(tm) this Elvis Week in Las Vegas.
Johnny Thompson had a one year contract at the Plaza Hotel in 2005 and since then has been touring around the world performing in concerts and production shows. Tours included Cancun Mexico, Bolivia, Korea, China, The Philippines, Finland, Belgium, Canada and Vietnam.
Johnny spent 6 weeks performing in 21 cities in France that included the largest concert venues in the country. The Creme d' le Creme was the famous "Palais de Congres" in downtown Paris. This same place where Pavarotti, James Brown and Ray Charles used to perform.
In 2007 Johnny won the San Diego State Fair's Ultimate Elvis Contest, which took him to Memphis for the finals. While in Memphis Johnny competed in a separate contest, The Images of the King Contest, the oldest and longest running Elvis Impersonator competition in the world. Johnny ended up winning the World Championship title against over 300 competitors from around the world.
Recently Johnny starred as Elvis in Carrie Underwood's music video "Last Name". Hand picked by Carrie's director for the part from dozens of Elvis Impersonators in Las Vegas. Johnny has also been offered movie roles, TV and Print work, and more world tours and international appearances.
"The King in Concert"(tm) will begin August 14th during Elvis Week and play every Friday, Sat and Sunday at the Las Vegas Country Saloon. Johnny will perform with his band, The Las Vegas TCB Band.

Fab, who entertained millions around the world as a member of Milli Vanilli, is about to do it again, this time on the motion picture screen with Universal Pictures to be executive produced by Kim Marlowe, written by Jeff Nathanson (The Terminal, Catch Me If You Can), with Kathleen Kennedy (Jurassic Park, Benjamin Button) as producer. The film takes place against the backdrop of his return to the music world as not just the singer, but a writer and performer, working with some of the finest young producers and writers in the R&B and Urban world. Entertainment Tonight dubbed him a modern-day cross between Marvin Gaye and Usher. "It was time for me to develop, to step up and write the songs - the stories - that were living in me and fighting to get out," says Morvan of the music he's been working on for the past year. "I can't say that this was a return to music for me, because I never really left, but writing and recording these new songs has put me back in touch with the special energy that can only be found in creating new music. This is very personal material, drawn from all my experiences, both the positive and the difficult. It is my way of working through what's happened to me."
Born in Paris, the son of an architect/builder and pharmacist, as a teen, he gravitated to British and American sounds: the Beatles, Queen, the Jackson 5 and Bob Marley. His musical roots got a boost from his grandfather, a fisherman/baker who played the accordion and took a young Fab on his musical travels throughout the Caribbean. Upon his move to Germany at 18, Morvan was exposed to the funk, rap and soul of Run DMC, Prince, the Gap Band, Parliament-Funkadelic and Sly & the Family Stone.
It was in Munich where Fab met Rob Pilatus in a local club and the two started a rock and soul band together. The two penniless and homeless kids jumped at the chance to sign a contract, and within months they had created a captivating stage show that would prove to enthrall millions as Milli Vanilli. Selling over 7 million copies of their debut album, Milli Vanilli - Girl You Know It's True, the duo went on to MTV stardom, becoming one of the biggest musical acts of the '90s, with worldwide sales of more than 30 million singles and 14 million albums. The popular VH1 series Behind the Music premiered with an episode spotlighting the duo, which was one of the highest-rated segments of the series.
Fab Morvan has proven a man of multiple talents, hosting his own midday show on L.A. radio bastion KIIS-FM, and performing at the station's sold-out Wango Tango festival concert before 50,000 people at Dodger Stadium. He's been featured on countless radio and television outlets, including BBC's documentary It Takes Two: The Story of the Pop Duo. After completing a successful summer tour sponsored by Malibu Rum, Morvan was the inaugural performer at the brand-new Velvet Lounge at the Hard Rock Café Hotel in Orlando, Fla., headlining the venue's gala opening. Fab Morvan has also performed during the Megablast radio programmers' convention in Las Vegas, and presented at the U.S. concert industry's prestigious Pollstar awards.
